JUST IN: CABESA EC ‘slapped’ with petition to withhold vetting; petitioner cite breaches in display of panel

A concerned member of the College of Art and Built Environment has petitioned the Judicial Chairperson to withhold vetting proceedings scheduled for today. The petitioner suggests that members of the college have been ambushed by Electoral Commission having displayed vetting panel less than 24 hours.

In a 2-page document, the petitioner has asked that the vetting slated for 3:30PM should be put on hold until the substantive matter is determined.

Mr. Eric Tambire reckons that the Electoral commission had breached article 15(4) of the CABESA constitution.

To him, the constitution mandates the EC to display vetting panel 3 days prior to the vetting.

” It is disheartening to have seen the panel members in less than 24hours to the vetting. This contradicts Article 15(4) of the CABESA constitution.

” For the avoidance of doubt, Article 15(4) states “Without prejudice to the provision above, the Electoral Commission shall within three (3) days prior to the vetting, present the members of the Vetting Committee to the aspirants who shall register any concerns, if any, about the proposed members through a petition to the Electoral Commission”.

The petition further sought for explanations to the verting criteria used in selecting panel amongst others.

In view of the breaches cited by the petitioner, Mr. Eric Tambire seeks the following reliefs;

  • That such vetting slated for Friday 4th June 2021 at 3:30 pm should be put on hold until the substantive matter is determined
  • That the Electoral Commission of CABESA has violated article 15(4) of the CABESA Constitution of 2015
  • And the panel should be declared null and void
  • Any other the court deems fit shall be granted

Meanwhile, sources can confirm that the SRC Electoral commissioner and SRC Juducial Chairperson have been duly served copy of the petition.
